Terms of Service
Effective July 10, 2026. These terms are a pre-launch draft and may be updated before general availability; material changes will be notified to account owners.
1. The service
Kinwell (operated at wellytic.app) provides wellness-monitoring software for senior-living facilities: presence sensing, wellness flags, staff alerting, and related dashboards. Kinwell supplements — and never replaces — professional care, clinical judgment, or emergency response. It is not a medical device and must not be relied on as the sole means of detecting emergencies.
2. Accounts and acceptable use
You are responsible for the accuracy of the information you provide, for safeguarding your credentials, and for the actions taken under your account. You may not misuse the service, attempt to access other organizations' data, resell access without authorization, or use the service in violation of applicable law.
3. Resident data and consent
Facilities are responsible for obtaining and maintaining lawful consent for resident monitoring, and for the accuracy of resident records they enter. Kinwell processes resident data on the facility's behalf as described in the Privacy Policy.
4. Availability and support
We work to keep the service available and alerting timely, but no uptime or delivery guarantee is made in these draft terms; service levels, if any, are set out in your order or subscription agreement.
5. Limitation of liability
To the maximum extent permitted by law, Kinwell is not liable for indirect, incidental, or consequential damages, and its aggregate liability is limited to the fees paid for the service in the twelve months preceding the claim.
6. Termination and changes
You may stop using the service at any time. We may suspend or terminate access for material breach. We may update these terms; continued use after notified changes constitutes acceptance.
